Acceptance of these Terms is required for the charter reservation and utilization of our Service. Should you not agree with any portion of these terms, you are not permitted to use the Service.

2. Service Overview

BreezeFarmStead offers a selection of top-tier yacht charter services, including but not limited to:

  • Yacht rentals for daily use
  • Evening boat rides
  • Company off-site trips
  • Exclusive gatherings
  • Lengthy yacht charters

Our services are dependent on availability and suitability of weather. We hold the right to change or to cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

Booking a yacht requires you to:

  • Have a minimum age of 18 years
  • Submit valid and thorough information
  • Make an initial deposit as outlined in your booking confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your reservation is finalized upon the successful processing of your payment and our issuance of written confirmation. We reserve the right to decline service to any individual as per our judgement.

3.3 Availability

Each charter is contingent upon both boat availability and agreeable weather conditions. Reasonable efforts will be made to honor your preferred scheduling.

4. Payment Terms

4.1 Pricing

Pricing is quoted in € and is inclusive of relevant taxes unless specified otherwise. Prices are subject to changes without initial notification.

4.2 Payment Schedule

  • Initial deposit: 50% of the complete cost of charter required at the time of booking
  • Remaining balance: Due 48 hours prior to the time of charter departure
  • Incidental expenses (if applicable): Payable upon the conclusion of the charter

4.3 Payment Methods

Accepted methods for payment include major credit cards, electronic bank transfers, and certified bank drafts. All payments are securely processed using encrypted management systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Cancellations made with more than 72 hours notice: Full refund minus any processing fees
  • Cancellations made within 24-72 hours of departure: 50% refund
  • Cancellations made less than 24 hours prior to departure: No refund provided

5.2 Weather Cancellations

In instances where the weather conditions are determined unsafe by our captain, we will propose either:

  • Rescheduling the charter to a forthcoming available date without additional costs
  • Issuing a full refund where rescheduling is unfeasible

5.3 Mechanical Issues

If mechanical disruptions occur with the vessel you were assigned, we will aim to offer a suitable substitution. If a replacement is not available, we will provide a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all directives provided by the crew
  • Utilize safety gear when it's deemed necessary
  • Inform us of any health conditions that may influence their security
  • Stay within designated areas on the vessel

6.2 Prohibited Items

Items not allowed on board include:

  • Bottles made from glass
  • Illegal narcotics
  • Firearms or other weapons
  • Excessive quantities of non-alcoholic drinks beyond reasonable consumption
  • Pets, except if they have been previously authorized

6.3 Conduct

Passengers are expected to behave in a manner that is respectful at all times. Failure to do so may result in the early termination of the charter without any refund, especially if the conduct endangers safety or interrupts the experience of others on board.

7. Liability and Insurance

7.1 Our Liability

We only accept liability up to the payment amount for your individual charter. We take no responsibility for:

  • Injuries sustained due to the negligence of a guest
  • Loss or damage of personal belongings
  • Indirect or secondary damages, or punitive repercussions
  • Delays due to weather or other circumstances that are outside of our control

7.2 Insurance Coverage

Comprehensive marine insurance is maintained by us, covering both our vessels and operations. It remains the guest's duty to secure their own travel and personal insurance.

7.3 Assumption of Risk

By partaking in our charter operations, you acknowledge the inherent dangers related to maritime activities and accept responsibility for your personal safety and well-being.

8. Modifications and Itinerary Changes

We hold the right to alter itineraries, passages, or schedules driven by conditions such as weather, safety, or operational demands. All efforts will be taken to offer alternative experiences of a similar nature.

9. Force Majeure

Events beyond our control that may lead to delays, cancellations, or changes in service include, but are not limited to:

  • Extreme weather events
  • Acts of nature
  • Governmental regulations
  • Port shutdowns
  • Vehicular breakdowns

10. Privacy and Data Protection

The usage and collection of your personal details are governed by our privacy norms as detailed in our Privacy Policy. By utilizing our Service, you give your assent to the handling of your information according to our Privacy Policy.
